End User License Agreement (EULA) for Pixel Starships 2

Effective Date: January 9, 2025

1. Acceptance of Terms By installing, copying, or otherwise using Pixel Starships 2 (“Game”), you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.

2. License Grant Savy Soda Pty Ltd (“Company”) grants you a non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial purposes on devices you own or control, subject to the limitations set forth herein.

3. License Restrictions You may not:

  • Modify, translate, adapt, or otherwise create derivative works or improvements of the Game.
  • Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the Game.
  • Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Game or any features or functionality of the Game, to any third party for any reason.

4. User Obligations You agree to comply with all applicable laws and regulations in connection with your use of the Game. You must not use the Game for any unlawful or fraudulent purposes, or to engage in any conduct that could damage, disable, overburden, or impair any server, or the network(s) connected to any server, or interfere with any other party’s use and enjoyment of the Game.

5. Intellectual Property The Game and all rights therein, including, without limitation, copyright, trademarks, and other intellectual property rights, are owned or licensed by the Company. Your use of the Game does not give you ownership of any intellectual property rights in the Game.

6. Termination This EULA is effective until terminated. You may terminate this EULA by deleting the Game and all copies thereof from your devices. The Company may terminate this EULA at any time without notice if you fail to comply with any of its terms.

7. Disclaimer of Warranties The Game is provided “as is” and “as available” with all faults and without warranty of any kind. The Company disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability To the fullest extent permitted by applicable law, in no event will the Company or its affiliates have any liability arising from or related to your use of or inability to use the Game for direct, indirect, incidental, consequential, special, or exemplary damages, including, but not limited to, loss of revenues, data, or profits, even if the Company has been advised of the possibility of such damages.

9. Indemnification You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of this EULA or your use of the Game.

10. Governing Law This EULA shall be governed by and construed in accordance with the laws of Victoria, Australia, without giving effect to any principles of conflicts of law.

11. Severability If any provision of this EULA is illegal or unenforceable, that provision will be severed from the EULA, and the remaining provisions will remain in full force.

12. Changes to EULA The Company reserves the right, at its sole discretion, to modify or replace this EULA at any time. If a revision is material, we will provide at least [30] days’ notice prior to any new terms taking effect.
